Welcome to ReadFluffy.com and the ReadFluffy mobile application. These Terms and Conditions ("Terms," "Terms of Service," or "Agreement") govern your access to and use of ReadFluffy's website at readfluffy.com and our mobile application (collectively, the "Services") provided by ReadFluffy ("ReadFluffy," "we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

1. ACCEPTANCE OF TERMS

By creating an account, accessing, or using our Services, you:

  • Acknowledge that you have read, understood, and agree to be bound by these Terms

  • Represent that you are at least 18 years old or have reached the age of majority in your jurisdiction

  • Confirm that you have the legal capacity to enter into this Agreement

  • Agree to comply with all applicable laws and regulations

If you are using our Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. DESCRIPTION OF SERVICES

ReadFluffy provides a digital platform for creating, editing, and managing stories through our website and mobile application. Our Services include:

  • Story creation and editing tools

  • Character development features

  • Plot management systems

  • Content organization capabilities

  • User account management

  • Community features (if applicable)

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time with or without notice.

3. USER ACCOUNTS AND REGISTRATION

3.1 Account Creation

To access certain features of our Services, you must create an account by providing accurate, current, and complete information during the registration process.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials

  • All activities that occur under your account

  • Notifying us immediately of any unauthorized use of your account

  • Choosing a strong password and keeping it secure

4. INTELLECTUAL PROPERTY OWNERSHIP

4.1 ReadFluffy's Intellectual Property

ReadFluffy and its licensors own all rights, title, and interest in and to the Services, including:

  • The ReadFluffy website and mobile application

  • All software, technology, and code underlying the Services

  • ReadFluffy trademarks, logos, and branding

  • All proprietary algorithms, features, and functionalities

  • Any improvements or derivative works of the above

4.2 User-Generated Content and Stories

IMPORTANT: BY USING OUR SERVICES TO CREATE STORIES, YOU ACKNOWLEDGE AND AGREE THAT:

All stories, characters, plots, narratives, and any other creative content created within or through the ReadFluffy Services ("User Stories") become the exclusive intellectual property of ReadFluffy upon creation.

This means:

  • Ownership Transfer: You hereby assign, transfer, and convey to ReadFluffy all rights, title, and interest in and to any User Stories you create using our Services, including all copyrights, moral rights, and other intellectual property rights

  • Exclusive Rights: ReadFluffy owns all rights to reproduce, distribute, display, perform, modify, create derivative works from, and otherwise exploit User Stories in any manner and through any media now known or hereafter developed

  • No Compensation: You acknowledge that ReadFluffy is not obligated to provide any compensation, attribution, or royalties for User Stories

  • Perpetual License: This transfer of rights is perpetual, irrevocable, and worldwide

4.3 User Representations and Warranties Regarding Content

By creating content using our Services, you represent, warrant, and covenant that:

  • Originality: All User Stories and content you create are entirely original works created by you

  • No Infringement: Your User Stories do not infringe, violate, or misappropriate any third-party intellectual property rights, including copyrights, trademarks, patents, trade secrets, moral rights, or any other proprietary rights

  • No Existing IP Conflicts: You are not duplicating, copying, adapting, or creating derivative works based on any existing stories, characters, plots, or other intellectual property owned by third parties

  • Authorization: You have all necessary rights, licenses, and permissions to create the content and to transfer ownership to ReadFluffy as specified in these Terms

  • No Prior Assignments: You have not previously assigned, licensed, or otherwise transferred rights in the content to any third party

4.4 User Responsibility for IP Violations

YOU ACKNOWLEDGE AND AGREE THAT:

  • Sole Responsibility: You are solely responsible for ensuring that your User Stories do not violate or infringe upon any third-party intellectual property rights

  • Legal Consequences: If you create content that infringes on existing intellectual property, any legal consequences, claims, damages, or liability arising from such infringement are entirely your responsibility

  • Defense and Indemnification: You agree to defend, indemnify, and hold harmless ReadFluffy from any claims, damages, losses, or expenses (including attorney fees) arising from your violation of third-party intellectual property rights

  • No ReadFluffy Liability: ReadFluffy bears no responsibility or liability for any intellectual property infringement claims related to User Stories, regardless of ReadFluffy's ownership of such stories

4.5 Content Monitoring and Removal

While ReadFluffy is not obligated to monitor User Stories, we reserve the right to:

  • Review, monitor, and analyze User Stories for any reason

  • Remove or disable access to any User Stories that we determine, in our sole discretion, may violate these Terms or third-party rights

  • Terminate user accounts for repeated or egregious violations

  • Cooperate with intellectual property owners and law enforcement in addressing infringement claims

5. PROHIBITED USES AND CONDUCT

You agree not to use our Services for any of the following prohibited purposes:

5.1 Illegal Activities

  • Violating any applicable laws, regulations, or these Terms

  • Engaging in any criminal activity or encouraging others to do so

  • Violating intellectual property rights of third parties

5.2 Harmful Content

  • Creating content that is defamatory, hateful, discriminatory, or harassing

  • Posting sexually explicit, violent, or otherwise inappropriate content

  • Creating content that promotes illegal activities or violence

5.3 Technical Violations

  • Attempting to hack, reverse engineer, or compromise our Services

  • Using automated systems or bots to access our Services

  • Interfering with the proper functioning of our Services

  • Attempting to bypass security measures or access restrictions

5.4 Commercial Restrictions

  • Using our Services for unauthorized commercial purposes

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, READFLUFFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OUR SERVICES.

8.4 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless ReadFluffy, its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney fees) arising from:

  • Your use of our Services

  • Your violation of these Terms

  • Your violation of any third-party rights, including intellectual property rights

  • Any User Stories you create or content you submit

  • Your negligent or wrongful conduct

10. TERMINATION

10.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion features in our Services.

10.2 Termination by ReadFluffy

We may terminate or suspend your account immediately, without prior notice, for any reason, including:

  • Violation of these Terms

  • Suspected fraudulent or illegal activity

  • Extended periods of inactivity

  • Business reasons or changes to our Services

10.3 Effect of Termination

Upon termination:

  • Your right to access and use our Services will cease immediately

  • We may delete your account and associated data

  • ReadFluffy retains all rights to User Stories created before termination

  • Provisions of these Terms that by their nature should survive termination will continue to apply

11. DISPUTE RESOLUTION

11.1 Governing Law

These Terms are governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to conflict of law principles.

16. ACKNOWLEDGMENT

BY USING OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. YOU SPECIFICALLY ACKNOWLEDGE AND AGREE TO THE INTELLECTUAL PROPERTY PROVISIONS IN SECTION 4, INCLUDING THE TRANSFER OF OWNERSHIP OF USER STORIES TO READFLUFFY AND YOUR SOLE RESPONSIBILITY FOR ANY INTELLECTUAL PROPERTY INFRINGEMENT ISSUES.

These Terms and Conditions are effective as of the date last updated above and apply to all users of ReadFluffy's website and mobile application.
